House Waysand Means Committee Holds Hearing on Tax Reform Thursday, January 20, House Ways and Means Chairman Dave Camp (R-MI) held a hearing, the first of a series on comprehensive tax reform. Witnesses invited to testify included Nina Olson, National Taxpayer Advocate; Robert McDonald, CEO of Procter & Gamble, representing the Business Roundtable (a group of large business CEOs); Warren Hudak, President of Hudak & Company; Kevin Hassett, Senior Fellow at American Enterprise Institute; and Martin Sullivan, Contributing Editor for Tax Analysts. New Guidance Issued—EAs Treated Equal to Other Legacy Circular 230 Practitioners

In a notice (Notice 2011-6) issued December 30, IRS provides guidance regarding the PTIN requirement under section 1.6109-2 and identifies the forms that qualify as tax returns or claims for refund for purposes of these regulations. Further, the notice provides interim rules applicable to certain PTIN holders during the implementation phase of the new preparer regulations. Several items are of great interest to enrolled agents, notably Section 1.02 (a), Tax Return Preparers Supervised by Attorneys, Certified Public Accountants, Enrolled Agents, Enrolled Retirement Plan Agents, and Enrolled Actuaries. President Signs Red Flag Clarification Act into Law President Obama has signed S. 3987, the Red Flag Clarification Act, into law. Cutting to the chase, the bill exempts “creditors”— including enrolled agents — who provide services and bill after the fact from the complicated requirement of the Red Flag rules. The legislation brings a bit of sanity to regulations by the Federal Trade Commission on the so-called Red Flag rules. These rules were originally intended to require creditors and financial institutions to adopt policies to protect consumers from identity fraud.
